Rederij Clipper Stad Amsterdam: General Terms and Conditions

Article 12 Force Majeure

In the event of the Offerer being prevented, due to permanent or temporary force majeure, from executing or proceeding with the execution of the Agreement, the Offerer shall be entitled, without being subject to any obligation to pay compensation, to have the Agreement declared dissolved either in whole or in part, by means of a written notification to that effect to the Client, without there being any need to provide for intervention by the courts, without prejudice to the Offerer's entitlement to receive payment from the Client in respect of any efforts having been performed by the Offerer before the situation of force majeure first arose. The Offerer shall notify the Client at the earliest opportunity of any situation of force majeure.

Article 13 Applicable Legal System

13.1 The Agreement and the present General Terms and Conditions shall be governed by Netherlands law.

 

13.2 Any disputes arising from the Agreement and/or the present General Terms and Conditions shall exclusively be referred to the competent court in Amsterdam. The client being a natural person not acting in the performance of a profession or business shall be entitled for the duration of at least one (1) month of the Offerer having invoked in writing the settlement of the dispute by the court referred to in the preceding sentence, to select the statutorily competent court in connection with the settlement of the said dispute.

These General Terms and Conditions have been tiled with the Amsterdam Chamber of Commerce and Industry under number 33298553.
